www.uae.fastandup.com  is an online service operated and managed by Aeronutrix Sports Products Pvt Ltd. ( ‘Fast&Up’ or ‘Fastandup’ or ‘Fast&up UAE’ or ‘we’ or ‘us’). In using the Fast&Up service, you are deemed to have accepted the terms and conditions of the agreement listed below or as may be revised when deemed fit (‘User Agreement’), which is, for an indefinite period and you understand and agree that you are bound by such terms till the time you access this Website. If you have any queries about the terms and conditions of this User Agreement or have any comments or complaints on or about the Website, please email us at customercare@aeronutrix.ae.  We reserve the right to change the terms and conditions of this User Agreement from time to time without any obligation to inform the customer (you) and it is the responsibility of the customer to look through them as often as possible.

Accuracy of content and invitation to offer:

We have taken all care and precautions to try and provide accurate data and information on this website. In the preparation of the content of this website, in particular to ensure that the product information and prices quoted are correct at time of publishing and all products have been fairly described. All prices displayed are inclusive of VAT. Product descriptions and images are for illustrative purposes only and do not constitute a contractual offer.

All content on this website, including but not limited to text, graphics, logos, images, and software, is the property of Fast&up UAE or its licensors and is protected by UAE and international intellectual property laws. You may use the website for personal, non-commercial use only.This website is designed, updated and maintained by Fast&up UAE or its licensors and associates. You shall not modify, publish, transmit, transfer, sell, reproduce, create derivative work from, distribute, repost, perform, display or in any way commercially exploit any of the content available on the website.

Registration:

If  you are required to or choose to register for an account on the website, your account is for your sole, and personal use. You may not authorize others to use your account and you may not assign or otherwise transfer your account to any other person or entity. All registration information about you must be truthful, you may not use any aliases or other means to mask your true identity. You are responsible for the security of your password and will be solely liable for any use or unauthorised use under such password.

Furthermore, by registering your e-mail address and phone number with us as a part of your account registration, you hereby expressly agree to receive communications from us via e-mails, phone calls, SMS and, or, customised push notifications on our website or mobile application, whether for any verification or towards promotional updates regarding our services and subscription plans.

Online Store Terms

By agreeing to these Terms & Conditions, you represent that you are at least 18 or have parental consent to use this website.

You may not use our products for any illegal or unauthorised purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).

You must not transmit any malware  or viruses or any code of a destructive nature on the website that compromises its functionality . A breach or violation of any of the Terms will result in an immediate termination of your usage to the Services on the website.

Pricing Information:

We strive to provide accurate product and pricing information. In the event that a product is listed at an incorrect price or with incorrect information due to an error in pricing or product information, We reserve the right to refuse or cancel any orders placed for products with incorrect pricing or information unless the product has already been dispatched. In the event that an item is mispriced, we may, at our sole discretion, either contact you for instructions or cancel your order and notify you of such cancellation. Unless the product ordered by you has been dispatched, your offer will not be deemed accepted and we solely at our discretion, will have the right to modify the price of the product and contact you for further instructions using the e-mail address or the contact number provided by you during the time of registration, or cancel the order and notify you of such cancellation. In the event we accept your order the same shall be debited to your credit / debit card account through the payment gateway or other such means as deemed fit and duly notified to you by email or the contact number, as the case may be, that the payment has been processed. The payment may be processed prior to dispatch of the product that you have ordered. If we have to cancel the order after we have processed the payment, the said amount will be reversed back to your credit / debit card account. All payments are processed in AED. We strive to provide you with best value, however prices and availability are subject to change without notice. 

Accuracy of Billing and Account Information

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.

You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

Financial Details:

You agree, understand and confirm that the credit / debit card details or other financial details provided by you for availing of services on the website will be correct and accurate and you shall not use the credit /debit card or financial facility which is not lawfully owned / obtained by you. Financial data is processed through secure third-party gateways, and _____ does not store sensitive card information. We are not liable for any misuse or fraud arising from payment transactions.

User Feedback and Submissions license: 

By submitting, posting, uploading, or otherwise providing any feedback, comments, ideas, suggestions, proposals, plans, testimonials, reviews, content, or other material (collectively, "Submissions") to Fast&Up UAE, whether solicited or unsolicited, via the website, email, social media, or any other communication channel, you hereby acknowledge and agree to the following:

• License Grant

You grant Fast&up UAE, its affiliates, subsidiaries, licensees, and successors an irrevocable, worldwide, perpetual, royalty-free, non-exclusive, sub-licensable, and transferable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, display, and otherwise exploit such Submissions in any form, media, or technology now known or later developed, for any purpose including but not limited to marketing, product development, promotional use, public relations, or commercial exploitation.

• No Compensation or Attribution

You understand and agree that no compensation, recognition, credit, or acknowledgment will be provided to you now or in the future for any use of your Submissions. Fast&up UAE is under no obligation to use or publish any Submission, nor to maintain it in confidence.

• Originality and Ownership

You represent and warrant that:

1. The Submission is your original work, and you possess all rights, title, and interest necessary to grant the license described herein;

2. Your Submission does not infringe upon or violate any third party’s rights, including but not limited to intellectual property rights (copyright, trademark, patent), privacy rights, publicity rights, moral rights, or any contractual or fiduciary obligations;

3. You have obtained all necessary consents, licenses, and permissions from any third party whose information, likeness, or intellectual property is included in your Submission.

• Content Restrictions

You agree not to submit any content that:

1. Is unlawful, defamatory, libelous, obscene, pornographic, harassing, threatening, abusive, hateful, offensive, harmful, or otherwise inappropriate;

2. Contains viruses, malware, or any other harmful code or material intended to damage or interfere with the operation of the website or any connected systems;

3. Violates any applicable law or regulation of the United Arab Emirates including but not limited to any other jurisdiction where the content may be accessed.

• Indemnity

You agree to fully indemnify, defend, and hold harmless Fast&Up UAE, its directors, officers, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in connection with:

1. A breach of your warranties and representations under this section;

2. Any claim that the Submission infringes or violates the intellectual property rights or other proprietary rights of any third party;

3. Any breach of applicable laws or regulations relating to your Submission.

• Waiver of Moral Rights

To the fullest extent permitted by applicable law, you hereby waive any moral rights (including the right to be identified as the author and the right to object to derogatory treatment) you may have in any Submission made to Fast&Up UAE.

• Retention and Removal

Fast&Up UAE reserves the right, but not the obligation, to monitor, edit, or remove any Submissions at its sole discretion and without notice, for any reason, including those that do not comply with these Terms or that may expose the company to potential liability.

Governing Law

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of United Arab Emirates  and the courts of Dubai shall have exclusive jurisdiction to settle matters pertaining to these Terms & Conditions and Privacy Policy.

Any claims asserted by you in connection with the website  must be asserted in writing to Fast&up UAE  within one (1) year of the date such claim first arose, or such claim is forever waived by you. Each claim shall be adjudicated individually, and you agree not to combine your claim with the claim of any third party.

If any portion of these Terms and Conditions is deemed unlawful, void or unenforceable, then that part shall be deemed severable and will not affect the validity and enforceability of any remaining provisions.

These Terms and Conditions set forth the entire understanding and agreement between you and Fast&up UAE with respect to the website. You acknowledge that any other agreements between you and Fast&Up  with respect to the website are superseded and of no force or effect.

Both you and Fast&up UAE acknowledge and agree that no partnership is formed and neither of you nor Fast&up UAE has the power or the authority to obligate or bind the other.

No waiver of any provision or of any breach of these Terms and Conditions shall constitute a waiver of any other provisions or any other or further breach.
